Andhra Pradesh Govt Notification to Open Retail Enterprise without Weekly off

Andhra Pradesh Govt Notification to Retail establishment and enterprises covered under sub section 4 of section 73 of Andhra Pradesh S & E Act, 1988 to keep the shops open for every day basis without any weekly off.

This exemption is initially provided to establishment under section 7, 9, 12, 23, 31 & 37 of the said Act for a period of five years from the issue of the official notification.

The notification has been issued on 1st November, 2022 vide notification number: 1440. However the Government imposes a number of rules and regulation to do so.

The major Conditions stated in the official notification is pointed out below:

  • Retails enterprises means shops under the provision of section 2(21) of the Andhra Pradesh S & E Act, 1988.
  • Employer should provide compensatory off, weekly Holiday to each employee without any deduction.
  • Working Hours for the employee is 8 hours per day which shall not exceed the weekly limit of 48 hours.
  • Records of overtime should maintain in wages register and overtime wages should be paid double the rate of normal wages.
  • Employee who worked in Holidays should be paid wages in double the rate of regular wages and compensatory leave should be provided to such employees.
  • Retail enterprises allowed to operate in between 6 am to 11 pm. And only allowed to run 2 shift with a minimum 1 hour change over time.
  • Women employees can be engaged in both shift but the employer mandatorily required to ensure the safety of the women employee along with conveyance of the women employee to their resident.
  • Employer also allowed to engage paert time employee but the total number of part time worker should not exceed 25% of the total employee count.
  • Wages should be paid to every employee in their respective bank Account.
  • Employer required to provide Appointment letter to each employee in proper format at the time of joining the establishment.
  • Employer mandatorily required to provide Provident Fund and ESIC facilities to eligible employees.
  • Employer can maintained registers and records in electronic form but in ready to produce form when ask by the Labour department and Authority.
